By accessing or using AustinMMO, AustinMMO.com, or any related websites, applications, stores, communities, plugins, services, contests, competitions, prediction systems, ticketing systems, point systems, rewards systems, or features operated by Austin Benjamin-Smith, doing business as AustinMMO and AustinMMO.com, an individual located in the State of Florida (“AustinMMO,” “Owner,” “we,” “us,” or “our”), you agree to these Terms of Service and Privacy Policy. If you do not agree, you must not access or use the Services. The Services may include user accounts, WordPress-based account features, game-related identifiers, Steam IDs, XBank balances, WooCommerce purchases, support tickets, public notices, contests, competitions, predictions, rewards, redemptions, leaderboards, and moderation systems. We may suspend, limit, terminate, or refuse access to any account or feature at any time if we believe you have violated these Terms, created legal or operational risk, attempted abuse, manipulated outcomes, used automation improperly, provided false information, engaged in fraud or collusion, harassed others, or otherwise threatened the fairness, legality, or integrity of the platform.

All points, credits, balances, currency, contest balances, prediction balances, and similar platform units (“Points”) are digital promotional or platform utility units only. Points are licensed, not sold as property. Points have no cash value, are not legal tender, are not bank deposits, are not wages, are not securities, are not investment products, and are not redeemable for cash except only if and when we expressly choose, in our sole discretion, to offer a particular redemption or reward program. Any package amount, exchange amount, price, rate, value, or store amount for Points is set solely by us and may be changed, limited, suspended, or discontinued at any time.

You understand and agree that Points are intended solely for use within the AustinMMO platform and associated systems. Points are non-transferable except where we expressly allow otherwise. Points may be modified, revoked, removed, corrected, frozen, forfeited, or reset if they were obtained through fraud, abuse, chargeback, reversal, exploit, technical error, moderation action, settlement correction, or policy violation. We reserve the right to correct any clerical, accounting, technical, display, settlement, balance, contest, reward, or transaction error at any time, including after Points have been displayed, added, deducted, awarded, transferred, or used.

Purchasing Points, point-bearing goods, or point-linked access does not create any ownership interest in Points or in the Services. Any value associated with Points is determined solely by us through our platform rules, store pricing, reward systems, and promotional settings. We may offer goods, services, memberships, or rewards in exchange for Points at rates determined exclusively by us. We may change or discontinue those offerings at any time.

If the Services include contests, competitions, tournaments, ladders, or similar events, you acknowledge and agree that such events are intended to be contests of skill, knowledge, performance, timing, strategy, participation quality, or other non-random criteria established by us and by the posted rules for the event. Nothing on the platform is intended to be or shall be interpreted as a game of chance, lottery, sweepstakes, casino game, gambling operation, sportsbook, or wagering service. Participation is void where prohibited. You are solely responsible for ensuring that your use of the Services is legal in your jurisdiction.

All contests, competitions, and prediction-style systems on the platform are provided solely as entertainment, community, skill, and engagement features. Outcomes, scoring, resolution, or reward determinations are governed by the specific rules, logic, and settlement standards published by us for the relevant feature. We reserve the right to interpret rules, determine eligibility, disqualify users, void entries, close participation, modify schedules, cancel events, reverse outcomes impacted by technical error or abuse, and make final decisions on disputes, misconduct, collusion, cheating, multi-accounting, botting, impersonation, boosting, and any conduct we determine harms fairness or legality.

Where the Services include paid or point-based contest entry, you acknowledge that any entry cost is consideration for access to a competitive platform feature, administrative handling, event hosting, moderation, infrastructure, support, prize support, or related services, and not payment for a game of chance. Where the Services include dynamic prediction or yes/no market features, you acknowledge that pricing and payout mechanics may change based on the number, timing, or weighting of user selections and according to platform-defined rules. We may cap payouts, adjust displayed values, or use risk-management controls so the platform does not operate at a loss unless we intentionally choose to subsidize a promotion.

We expressly state that no user is purchasing a chance-based opportunity to win cash. Points and rewards offered through the platform are subject to the platform’s internal valuation and rules. Except where we explicitly provide otherwise, rewards are promotional, discretionary, and subject to eligibility, verification, integrity review, and platform rules. We may refuse, delay, reduce, reverse, or cancel any reward, redemption, prize, or payout where we suspect fraud, manipulation, technical error, rules abuse, ineligibility, legal risk, or unauthorized conduct.

If the Services include stores or checkout systems, all sales are final unless otherwise required by law or expressly stated by us in writing. We may deny, reverse, or restrict purchases where fraud, abuse, unauthorized payment use, chargeback risk, or suspicious activity is detected. If you initiate a chargeback or payment dispute, we may suspend your account, reverse related Points, revoke related entries or rewards, and take any action reasonably necessary to protect the platform.

You are responsible for all taxes, duties, governmental fees, reporting obligations, and legal compliance obligations arising from your use of the Services, your purchases, your participation in contests or predictions, and any rewards or redemptions you receive. We make no representation regarding the tax treatment or legal treatment of any reward, redemption, or account activity.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. We may modify, rebalance, suspend, discontinue, reset, or terminate any feature, reward structure, contest, prediction system, point system, ticket system, or account functionality at any time, with or without notice. We may also post public tickets, public notices, incident notices, maintenance notices, bug reports, or downtime notices where appropriate.

If the Services include support tickets, reports, moderation requests, or contact forms, you agree not to submit unlawful, threatening, defamatory, obscene, infringing, abusive, deceptive, or confidential third-party information. We may retain, review, escalate, investigate, and use any tickets, messages, reports, and related metadata for support, moderation, legal compliance, fraud prevention, and enforcement purposes.

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, availability, or error-free operation. We do not warrant that the Services will meet your expectations or that any Points, rewards, contest entries, or prediction positions will retain any particular availability or value.

To the fullest extent permitted by law, Austin Benjamin-Smith, AustinMMO, AustinMMO.com, and any affiliates, moderators, staff, agents, contractors, volunteers, or service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, goodwill, data, access, opportunities, expected benefits, or virtual balances arising out of or relating to the Services. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the greater of fifty U.S. dollars (US $50.00) or the amount you paid directly to us in the thirty days preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Austin Benjamin-Smith, AustinMMO, AustinMMO.com, and any affiliates, moderators, staff, agents, contractors, volunteers, or service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms, your violation of law, your infringement of any right, your fraud, your payment disputes, your contest or prediction abuse, or your content, reports, or conduct.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Services shall be brought exclusively in the state or federal courts located in Florida, and you consent to that jurisdiction and venue. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision shall not be a waiver of that provision.

We may use and display account-related information inside the platform where necessary for feature operation, including display names, usernames, contest standings, prediction positions, support history, and reward status. Public notices, public tickets, public contest results, public leaderboards, or public service messages may display limited information such as usernames, display names, rankings, event outcomes, or status information where relevant to that feature.

We do not sell your personal information for money in the ordinary commercial sense. We may, however, share information with service providers, hosting providers, payment processors, analytics providers, cloud providers, moderators, game masters, contractors, professional advisors, law enforcement, regulators, courts, and others where reasonably necessary to operate the Services, investigate abuse, process transactions, comply with law, enforce our Terms, or protect our rights, users, or property.

If the Services use third-party systems such as WordPress, WooCommerce, Steam, Discord, payment processors, analytics providers, anti-fraud tools, email delivery tools, bot systems, or server integrations, your information may also be processed by those third parties according to their own terms and privacy practices. We are not responsible for third-party systems we do not control.
